Terms of Service
Effective date: May 7, 2026
These Terms of Service (“Terms”) govern your access to and use of Framous, the iOS app and related services (collectively, “Framous,” the “Service”) operated by Brian Moore (“we,” “us”). By creating an account or using Framous, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Framous. By creating an account, you confirm that you meet that age requirement. To sign in, you also need a valid Apple ID and a phone number that can receive SMS messages for one-time verification codes. You are responsible for maintaining the security of your Apple ID and phone number; we treat anyone who can sign in with your Apple ID as you.
2. The Service
Framous is a daily photo lottery. Once per day at noon Eastern Time, the Service randomly selects one user from the eligible pool using a weighted “luck” system. The selected user has 60 minutes to take a single photo, which is then broadcast to all other users. Other users may react with emoji. There is no other way to post on Framous — every photo on the platform comes from a daily winner.
Selection is randomized and we make no promise that any particular user will ever be chosen, or chosen within any particular timeframe. The mechanics, schedule, and weighting of the lottery may change as we refine the Service.
3. Your content
You retain all rights to the photos and other content you submit through Framous (“Your Content”). By submitting Your Content to the Service, you grant Framous a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, transmit, display, reformat, and distribute Your Content within the Framous service for the purpose of operating, providing, and improving the Service.
You represent and warrant that you own or have the necessary rights to Your Content, that it does not infringe anyone else’s rights, and that it complies with these Terms.
4. Prohibited content
Framous uses a combination of automated content moderation (via our partner Hive) and human review. The following are not allowed on Framous and will be rejected automatically or removed:
- Explicit nudity or sexual content;
- Gore or graphic violence;
- Weapons being held or pointed;
- Hate symbols or content promoting hate groups;
- Extreme violence or content glorifying it;
- Child sexual abuse material (CSAM), which is detected separately and reported as required by law.
Posts that violate these rules will be rejected, and repeated or severe violations will result in account termination. We may also report illegal content to the appropriate authorities.
5. Acceptable use
You agree that you will not:
- Harass, threaten, defame, or stalk other users, or post content that does so;
- Impersonate any person or misrepresent your affiliation with anyone;
- Use any automated means (bots, scrapers, crawlers) to access, create, or interact with accounts or content on Framous;
- Create accounts by automated means or operate more than one account per person to game the lottery;
- Attempt to reverse-engineer, decompile, or otherwise interfere with the Service or its security;
- Use Framous for any commercial purpose, including advertising or promotion of products or services, without our prior written permission;
- Violate any applicable law or regulation in connection with your use of the Service.
6. Termination
You can delete your account at any time from within the app. Deletion immediately removes you from the eligible lottery pool; full data deletion follows the timeline described in our Privacy Policy. We may suspend or terminate your account at our discretion if you violate these Terms, if your conduct creates risk for Framous or other users, or if we are required to do so by law. We may also discontinue the Service entirely with reasonable notice.
7. Disclaimers
FRAMOUS IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or free from harmful components, or that any content (including Your Content) will be preserved or available at any given time.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL FRAMOUS OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (WHICH IS CURRENTLY ZERO, AS THE APP IS FREE) OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you; nothing in these Terms limits any liability that cannot be limited under applicable law (such as liability for gross negligence, willful misconduct, or fraud).
9. Indemnification
You agree to defend, indemnify, and hold harmless Framous, its operator, and its agents and employees from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) Your Content, (b) your use of the Service, or (c) your violation of these Terms or any law or rights of a third party.
10. Governing law and dispute resolution
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Except as set out below, any dispute arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration administered by JAMS in San Francisco, California, under its then-current rules. Judgment on the award may be entered in any court of competent jurisdiction.
Either party may bring an individual action in small-claims court in lieu of arbitration, and either party may seek injunctive relief in court for intellectual-property infringement. You and Framous each waive the right to a jury trial and the right to participate in a class action. If the class-action waiver is found unenforceable as to any claim, then that claim will be severed from the arbitration and proceed in court, while all other claims continue in arbitration.
11. Changes to these Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days’ notice in-app or by email before the changes take effect. Continued use of the Service after the effective date means you accept the updated Terms.
12. Miscellaneous
These Terms, together with our Privacy Policy, are the entire agreement between you and Framous regarding the Service. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms; we may assign them in connection with a sale, merger, or reorganization. These Terms do not create any agency, partnership, or joint-venture relationship between you and us.
